Article 50(3) EU AI Act Deployer Instructions

Applicability: These instructions apply where Anxiety or Mental Stress Index is enabled and used to infer emotions or intentions from facial video-derived biometric signals. In such cases, the functionality must be treated as emotion recognition under Regulation 2024/1689 (EU AI Act).

Permitted use: Use the functionality only for the documented intended purpose and approved configuration. It must not be used for emotion inference in workplace or education contexts unless a medical or safety exception is legally available and documented. Outputs are estimates, not diagnoses or substitutes for professional judgment, and must not be the sole basis for decisions significantly affecting a person.

Required notice: The deployer must provide the following notice clearly, accessibly and in context, before or no later than first exposure:

AI Emotion-Recognition Notice

This measurement uses DeepAffex AI functionality to infer anxiety and mental stress index and generate the related output.

Under Regulation (EU) 2024/1689 (EU AI Act), Anxiety and Mental Stress Index measurements are prohibited for emotion recognition use of a natural person in workplaces or educational institutions in the European Union, except where the use of those measurements is for medical or safety reasons as permitted by applicable law.

Implementation: Do not remove or obscure any notice supplied by NuraLogix. Apply equivalent requirements to downstream deployers. Retain the enabled-output and version record, the notice used, implementation evidence, any applicable exception assessment and downstream acknowledgements.
